Trademark Clearance-and-File Package: Word Marks, Logos, Icons, and Slogans
A flat-fee package that takes a brand from search to filed application. For each mark you select, we order a comprehensive search report, review the results, give you a written risk opinion, and prepare and file your federal trademark application.
Attorney flat fees, per application (up to three classes included):
Word mark: $1,095
Logo or icon: $1,295
Slogan or tagline: $1,050
Four-mark bundle (word mark, logo, icon, and slogan, filed as four applications): $4,495
USPTO fees are charged per class: $350 per class using Trademark ID Manual identifications, or $550 per class when a custom identification is required.
Example totals:
Four-mark bundle, one class each: $5,895 with ID Manual identifications, or up to $6,695 with custom identifications.
Four-mark bundle, two classes each: $7,295 with ID Manual identifications, or up to $8,895 with custom identifications.
Ideal For:
Businesses in any industry protecting a new or existing brand name, logo, icon, or tagline.
Brands that need protection in more than one class, since the attorney fee stays the same from one class to three.
Startups reserving rights before launch on an intent-to-use basis, and established businesses whose marks are already in use.
Clients who want a fixed budget from search through registration, with no hourly billing.
Companies filing one mark now and adding more later at the same published rates.
Includes:
A comprehensive search report for each mark, prepared by the firm.
Word marks and slogans are searched for identical and similar marks in USPTO records, all 50 state trademark registries, common-law sources, business names, domain names, and app stores where relevant.
Logos and icons are searched by USPTO design code for visually similar marks.
The search covers every class in the application at no added attorney fee.
A written attorney clearance opinion for each mark, with a risk rating (low, moderate, or high), the closest conflicts identified, and a recommendation on whether to proceed.
Class strategy for up to three classes per application, with identifications of goods and services drafted from the USPTO ID Manual wherever an accurate entry exists.
A custom identification when no ID Manual entry fits, drafted at no extra attorney fee and kept under 1,000 characters per class.
Advice on the filing basis: intent-to-use (ยง 1(b)) or use-based (ยง 1(a)).
Preparation and electronic filing of one application per mark.
Drawing review for logos and icons, including the color-claim decision and a written description of the mark.
Specimen review for use-based filings.
Firm coverage of the USPTO insufficient-information surcharge ($100 per class). If that surcharge is ever assessed on the application, the firm pays it.
Filing receipt, docketing of every USPTO deadline, and status reporting through the first USPTO action.
A brand-usage memo covering โข and ยฎ use and specimen guidance.
Excludes:
Office action responses, available as fixed-fee add-ons, per application:
Non-substantive response: $260.
Substantive response (likelihood of confusion, descriptiveness, or failure to function): $1,095.
Statements of Use and Amendments to Allege Use: $225 per application, plus the USPTO fee of $150 per class.
Statement of Use extension requests: $95 per application, plus the USPTO fee of $125 per class.
Trademark watch: $260 per mark per year.
USPTO free-form surcharges ($200 per class) and excess-character surcharges ($200 per additional 1,000 characters, per class). These apply only when needed, and they are disclosed and quoted in writing before filing.
Applications with four or more classes, which are quoted in writing before engagement.
Foreign and Madrid Protocol filings.
Oppositions, cancellations, Trademark Trial and Appeal Board (TTAB) appeals, cease-and-desist letters, and litigation.
Logo design, entity formation, IP assignments, and copyright registration.
Rebrand analysis, or searches on replacement marks after a high-risk result.
Patent and design patent work.
Deliverables:
A comprehensive search report for each mark, with the full results delivered to the client.
A written clearance opinion for each mark, with a risk rating and a recommendation.
A written fee confirmation before filing, showing the USPTO fees and any surcharges for each class.
A filed USPTO application for each mark that clears, with its serial number and filing receipt.
A deadline docket report.
A brand-usage and specimen-guidance memo.
Assumptions and Limitations:
Each attorney fee covers one mark in one application, with up to three classes.
USPTO fees are charged per class, and they are billed at cost with no markup.
If a search report returns a high-risk result, the client may stop before filing. In that case, the firm refunds the unused USPTO fees and $300 of the attorney fee for that mark.
The applicant entity exists and owns the mark, including the rights to any logo or icon artwork, before filing.
Logo and icon artwork is final when the search is ordered. If the artwork changes after the search, a new search is required and is quoted in writing.
Classes cannot be added to an application after it is filed. Adding a class later requires a new application at the published rate.
Custom identifications are used only when no ID Manual entry accurately covers the goods or services. The client is told in writing which classes need one before approving the filing.
USPTO fees and surcharges are set by the USPTO, and the fees in effect on the filing date apply. If a fee changes after the client has been quoted, the client is notified before filing.
Search reports and opinions reduce risk but cannot guarantee registration or reveal every prior user, because some users never register their marks.
Slogans often receive failure-to-function refusals. The filing fee does not guarantee registration.
Scope-Change Triggers:
A request for additional marks, a fourth or later class in an application, or foreign filings.
A request to add classes after filing, which requires a new application.
A request for identifications broader than the firmโs recommended wording, including wording that exceeds 1,000 characters in a class.
A high-risk search result, when the client wants a rebrand strategy, a coexistence approach, or a search on a replacement mark.
Changes to the artwork, the goods and services, or ownership after the search is ordered.
A third-party opposition, letter of protest, or demand letter.
A request for filing faster than the listed turnaround.
Typical Turnaround:
Search started: within 2 business days of intake.
Search report and clearance opinion delivered: 7โ12 business days after the search starts.
Application filed: 3โ5 business days after the client approves the filing and all required information is received.
First USPTO action: typically several months after filing. The USPTO controls this timeline.
Client Responsibilities:
Provide the applicantโs legal name, entity type, and address.
Provide final logo and icon artwork in high-resolution JPG or PNG format.
Describe all current and planned goods and services, so every needed class is included before filing.
Disclose any existing use, including first-use dates and where the mark appears.
Confirm ownership of the mark and the artwork, including assignments from founders or designers.
Review and approve each filing, including the fee confirmation, within 5 business days.
Keep dated specimens showing use, and notify the firm promptly of brand changes or third-party contact about the mark.
